In order to ensure that Care for Mom's treatments and services run as smoothly as possible, Care for Mom applies a number of conditions. When submitting an application, making an appointment or making a reservation, Care for Mom assumes that you have read and agree to the following conditions.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Article 1 Applicability<\/h5>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

General terms and conditions of Care for Mom located and having her office at Brandaris 17 2134 XV in Hoofddorp, registered with the Chamber of Commerce in Amsterdam under registration number 77068998.<\/p>

  • These terms and conditions are communicated through Care for Mom's website (http:\/\/www.careformom.nl\/algemene-voorwaarden) and by e-mail and will be sent by post upon request.<\/li>
  • Every legal relationship between Care for Mom and the treatments, hereinafter called \"Services\", provided by Care for Mom, participating person and\/or representative of this person, hereinafter called \"Client\", is exclusively governed by the present terms and conditions.<\/li>
  • The applicability of any general terms and conditions used by the Client is expressly excluded. Should one or more of the provisions in these general terms and conditions be invalid or be annulled, the remaining provisions of these general terms and conditions shall continue to apply in full.<\/li>
  • The provisions contained in the articles of these general terms and conditions apply to every offer and\/or agreement entered into between Care for Mom and the Customer, unless Care for Mom has explicitly deviated from these terms and conditions in writing.<\/li>
  • You accept the applicability of these terms and conditions as the Client by the mere fact of your order.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t

    Article 2 Applications<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t
    1. Requests for services are made via the registration form on the website, by e-mail or by telephone and are made in order of receipt. An agreement comes into being after the down payment for a reservation of the Customer has been received by Care for Mom and\/or through the written confirmation of the Service by Care for Mom to the Customer. This confirmation takes place by email.<\/li>
    2. Prices are stated in Euros and include the legal VAT, unless stated otherwise.<\/li>
    3. Applying for a Service automatically and immediately implies that the Customer declares to be physically and mentally healthy and that the Customer is fully responsible for the consequences for his own body and his own health.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
      \n\t\t\t\t
      \n\t\t\t\t\t

      Article 3 Performance of the Agreement<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
      \n\t\t\t\t
      \n\t\t\t\t\t\t\t\t\t
      1. Care for Mom will endeavour to perform the Service to the best of her ability at all times. Care for Mom is never liable for failing to achieve the result that the Customer intended.<\/li>
      2. The Customer is responsible for providing Care for Mom, in a timely manner, with all information that Care for Mom indicates is necessary or that the Customer should reasonably understand is necessary to carry out the Service.<\/li>
      3. Care for Mom is entitled to employ third parties to carry out the service. Care for Mom will exercise due care in selecting such third parties. All knowledge\/activities offered by Care for Mom within the framework of the Service are explicitly not medical treatments. These treatments\/services are intended to provide support, rest, relaxation and information. Participation in the Service is entirely at your own risk.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
        \n\t\t\t\t
        \n\t\t\t\t\t

        Article 4 Postpartum Treatment\n<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
        \n\t\t\t\t
        \n\t\t\t\t\t\t\t\t\t
        1. Care for Mom will never claim to cure any illness or condition and will never advise stopping or changing any regular medication or treatment recommended by a doctor.<\/li>
        2. All knowledge and treatments offered through the Service by Care for Mom are expressly not medical treatments. These treatments\/services are for support, rest, relaxation and the provision of information. Participation in the Service is entirely at your own risk.<\/li>
        3. The Customer is responsible for providing Care for Mom, in a timely manner, with all information that Care for Mom indicates is necessary or that the Customer should reasonably understand is necessary to carry out the Service.<\/li>
        4. Ethics and hygiene are of paramount importance to Care for Mom and are expected of the Customer in return.<\/li>
        5. Mutual respect in a safe atmosphere is a matter of course for both Care for Mom and the Customer.<\/li>
        6. Care for Mom reserves the right to refuse a client.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
          \n\t\t\t\t
          \n\t\t\t\t\t

          Artikel 5 Wijziging & Annulering door Care for Mom\n<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
          \n\t\t\t\t
          \n\t\t\t\t\t\t\t\t\t
          1. In the event of unforeseen circumstances, Care for Mom can at all times interrupt, move and\/or cancel the Service. Unforeseen circumstances, as referred to in this paragraph, include Nicole Wijnhoven's illness and circumstances concerning persons and\/or materials which are necessary for Care for Mom's proper implementation.<\/li>
          2. In the event of any change and\/or cancellation by Care for Mom, the Customer will be notified of the rescheduling of the cancelled Service, or a suitable alternative will be sought.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
            \n\t\t\t\t
            \n\t\t\t\t\t

            Article 6 Force Majeure<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
            \n\t\t\t\t
            \n\t\t\t\t\t\t\t\t\t
            1. In the event of force majeure, Care for Mom is entitled to interrupt, reschedule and\/or cancel the Service. Force majeure includes circumstances beyond Care for Mom's reasonable control, such as accidents, fire, illness, death of a close family member and extreme weather conditions.<\/li>
            2. In the event that the Service is cancelled, the provisions of Article 5, paragraph 2 apply accordingly.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
              \n\t\t\t\t
              \n\t\t\t\t\t

              Artikel 7 Wijziging & Annulering door Client<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
              \n\t\t\t\t
              \n\t\t\t\t\t\t\t\t\t
              1. Cancellation is only possible in writing or by telephone (e-mail, SMS, whatsapp). When cancelling the reservation for a postpartum treatment up to fourteen days before the due date, no administration costs will be charged. When cancelling between fourteen days and seven days before the due date, half the reservation costs will be charged. No refunds are given from seven days before the due date.<\/li>
              2. Cancellation of an already made appointment for a treatment after childbirth is free of charge until 24 hours before the appointment. In case of cancellation after 24 hours before the scheduled appointment, the full amount will be charged. With the exception of force majeure on the part of the Client, such as fever, inflammation or hospitalisation.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
                \n\t\t\t\t
                \n\t\t\t\t\t

                Article 8 Payment<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
                \n\t\t\t\t
                \n\t\t\t\t\t\t\t\t\t
                1. The cost of a reservation must be paid within 7 days of the date of the invoice to the account number of Care for Mom, stating the invoice number.<\/li>
                2. Fees for one-off treatments should be paid immediately after the treatment has ended, by PIN payment, payment request or in cash, unless explicitly stated otherwise or agreed upon in writing.<\/li>
                3. In the event of late payment as described in paragraph 2 of this article, Care for Mom is at all times entitled not to include a reservation for the service in her agenda. Should this be the case, then the Customer's right to Service lapses.<\/li>
                4. Gift vouchers are valid for 1 year after the date of the birth of the Client. The Client is responsible for making appointments within the period of 1 year after the invoice date. After this period the right for the Customer to have the Service provided expires, unless explicitly stated otherwise or agreed upon in writing.<\/li>
                5. Care for Mom reserves the right to make interim price changes.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
                  \n\t\t\t\t
                  \n\t\t\t\t\t

                  Article 9 Costs for exceeding the term of payment<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
                  \n\t\t\t\t
                  \n\t\t\t\t\t\t\t\t\t
                  1. If you fail to make timely (full) payment, you are in default without any further notice of default being required. If the amount due has not been paid on the due date, Care for Mom will send you a first reminder, free of charge, with a request to pay within seven (7) calendar days. If this term passes without Care for Mom having received the amount due, you will receive a second reminder, stating that extrajudicial collection costs will be charged if the term of payment of this reminder is exceeded. An exception is the reservation where, after the second reminder, it will be removed from the schedule and the service to the Customer will be cancelled.<\/li>
                  2. If collection measures have to be taken, you are legally obliged to reimburse all judicial and extrajudicial (collection) costs reasonably incurred. The amount of the extrajudicial collection costs is calculated on the basis of the Decree on compensation for extrajudicial collection costs (Besluit vergoeding voor buitengerechtelijke incassokosten). For claims up to \u20ac2,500, this means a possible compensation of maximum fifteen percent (15%) of the principal amount, with a minimum of \u20ac40,-<\/li>
                  3. If, after the second reminder, you still fail to pay the amount due, Care for Mom may assign its claim against you to a third party. In doing so, all costs incurred in connection with Care for Mom's outstanding claim will be at the expense of the Customer, as well as the costs of any legal proceedings.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
                    \n\t\t\t\t
                    \n\t\t\t\t\t

                    Article 10 Liability<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
                    \n\t\t\t\t
                    \n\t\t\t\t\t\t\t\t\t
                    1. Care for Mom is niet aansprakelijk voor verlies, diefstal of beschadigingen van persoonlijke eigendommen of meegebrachte materialen van Cli\u00ebnt gedurende de Dienst.<\/li>
                    2. Behoudens ingeval van opzet of grove schuld aan de zijde van Care for Mom, is Care for Mom op geen enkele wijze aansprakelijk te stellen voor enig lichamelijk of geestelijk letsel dat Cli\u00ebnt overkomt tijdens of als gevolg van deelname aan Dienst.<\/li>
                    3. Aansprakelijkheid van Care for Mom voor indirecte schade, waaronder mede begrepen gevolgschade, gederfde winst, en schade door bedrijfsstagnatie is te allen tijde uitgesloten.<\/li>
                    4. Iedere eventuele aansprakelijkheid van Care for Mom uit hoofde van een gebeurtenis \u2013 daaronder begrepen een nalaten \u2013 die tot aansprakelijkheid leidt, is beperkt tot de kosten van de Dienst waarmee de schade een verband heeft.<\/li>
                    5. De aansprakelijkheid van Care for Mom is te allen tijde beperkt tot het bedrag dat uit hoofde van een eventueel afgesloten beroeps-\/bedrijfsaansprakelijkheidsverzekering van Care for Mom in het betreffende geval zal worden uitgekeerd.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
                      \n\t\t\t\t
                      \n\t\t\t\t\t

                      Artikel 11 Intellectuele Eigendomsrechten<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
                      \n\t\t\t\t
                      \n\t\t\t\t\t\t\t\t\t
                      1. De intellectuele eigendomsrechten op de Care for Mom aan Cli\u00ebnt ter beschikking gestelde materialen en de website van Care for Mom berusten bij Care for Mom. Het is Cli\u00ebnt nadrukkelijk niet toegestaan het materiaal en\/of de verstrekte documentatie en\/of informatie van de website te verveelvoudigen, openbaar te maken of ter beschikking te stellen aan derden zonder voorafgaande schriftelijke toestemming van Care for Mom.<\/li>
                      2. Het maken van beeld- en\/of geluidsopnamen tijdens een Dienst door Cli\u00ebnt is uitdrukkelijk verboden, tenzij expliciet anders aangegeven of schriftelijk overeengekomen.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
                        \n\t\t\t\t
                        \n\t\t\t\t\t

                        Article 12 Confidentiality<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
                        \n\t\t\t\t
                        \n\t\t\t\t\t\t\t\t\t
                        1. Both parties are obliged to maintain the confidentiality of all confidential information they receive from each other in the course of their agreement. Information is considered confidential if this has been explicitly stated by one of the parties or if this follows from the nature of the information.<\/li>
                        2. When applying for a Service the Customer's personal data will be used in accordance with the provisions in the Privacy Statement<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
                          \n\t\t\t\t
                          \n\t\t\t\t\t

                          Article 13 Special provisions<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
                          \n\t\t\t\t
                          \n\t\t\t\t\t\t\t\t\t
                          1. Care for Mom reserves the right to exclude from further treatment those Clients whose behaviour or otherwise obstructs or hampers the normal course of the Service, bearing in mind the interests of Care for Mom and the Client. Exclusion does not affect the obligation to pay.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
                            \n\t\t\t\t
                            \n\t\t\t\t\t

                            Artikel 14 Toepasselijk recht & Geschillen<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

                            1. Dutch law applies to the legal relationship between the Customer and Care for Mom.
